You will be asked to agree to these terms when you pick up your puppy.

(This contract may be updated from time to time)

 

 

The following terms constitute a Bill of Sale and Contract between the Seller, Jacqueline Makoujy, and the Buyer, __________ regarding the Cocker Spaniel puppy described below. .

These terms are entered into and agreed upon by all parties as of this date, _________________. Therefore, it is agreed:

 

• This puppy is sold with an AKC Limited Registration, it is understood that the puppy is sold as a companion only and will not be used for breeding purposes unless she obtains her AKC Championship and has completed all necessary health testing. Any violation of the non-breeding terms of this agreement would constitute a breach of contract.  Should such a breach occur at any time then liquidated damages in the amount of the difference in the price between companion and breeding animals will be accessed to the Buyer.  The difference in price is declared as triple the amount of the purchase price as indicated above.   Neutering of male puppies is optional and is NOT recommended until the appropriate age of at least 18 months old.  Spaying is however, recommended for all female puppies.  The Buyer agrees NOT to have this puppy spayed before she is 18 months old.  Early Neutering/Spaying VOIDS any and all health guarantees.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: ________ Date: _______

• This puppy has been delivered to the Buyer with age-appropriate inoculations and dewormings. I strongly recommend that your veterinarian also examine this puppy within 72 hours of purchase.  This should be a WELLNESS checkup only and no vaccinations should be given at this time.  The Buyer agrees to follow the CAVIDS Nomograph for the required Parvo and Distemper vaccinating dates for this litter/puppy.  Please see the results of the titer test that was done on this puppy to confirm that she has been successfully immunized against Parvo and Distemper.  No additional Parvo and Distemper vaccines will be required for the life of this dog.  The only vaccine this puppy will need is a Rabies vaccine as required by law in your state.  Failure to follow this protocol VOIDS any and all health guarantees as well as endangers the life of this puppy.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: ________ Date: _______

   

• This puppy is guaranteed to be free of life-threatening congenital defects for one (1) year from date of birth. If a congenital defect is suspected, the Buyer shall notify the Seller within three (3) days of diagnosis and provide the Seller with a veterinarian’s written report. The Seller reserves the right to have the dog checked by a veterinarian of my choice and if the prognosis is confirmed, I will replace the dog as availability allows. All warranties are for replacement and/or credit only and not for refund of purchase price in whole or in part or for reimbursement of medical/veterinary expenses in whole or in part. • The Buyer acknowledges that the Cocker Spaniel, like many other breeds, does have some common health concerns inherent to all breeds of dogs. These include, but are not limited to: parasites, cherry eyes, hernias, allergies, patellar luxation, diabetes, Grade 1 heart murmurs and autoimmune disease.  These health concerns as well as any disease/condition that is brought on by diet, over vaccination, flea and tick medications or other environmental factors or due to injury are excluded from this guarantee. The Buyer assumes all responsibility and future subsequent treatment for any and all health problems discovered after the initial veterinary exam. At no time will financial restitution be made to the Buyer for health problems incurred. • The Buyer agrees to harbor this puppy as a “family pet and companion” in the home. The puppy will not be tied out or allowed to roam at large off of the Buyer’s property. It is highly recommended that the owner has a completely fenced yard. The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: _____________ Date: _______

• The Buyer agrees that this puppy will not be subjected to tobacco smoke (pipes, cigars or cigarettes) in its home.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: _____________ Date: _______

• The Buyer agrees that this puppy will never be given any oral Flea and Tick preventative (i.e.; BRAVECTO, NEXGARD, TRIFEXIS, COMFORTIS, SIMPARICA) or use any Flea and Tick collar (i.e.; SERESTO). This is due to the history of these products causing life threatening side effects including seizures and death.  In my opinion the safety studies on these products are inadequate.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: _____________ Date: _______

 

• The Buyer agrees to vaccinate in accordance with the Nomograph as completed by CAVIDS at the U. of Wisconsin.  The Nomograph is included in the Puppy Folder.  The Buyer agrees not to over vaccinate this puppy with yearly or triennial vaccines (Parvo and Distemper) and to contact the Seller if at any time they have questions regarding immunizations that this puppy (or adult dog) should receive.  The Rabies vaccine should be given no sooner than 7 months of age in the State of NJ.  Please see RabiesAware.org for the laws regarding the Rabies vaccine requirements for your state.  At no time should this puppy (or adult dog) receive the vaccine for Leptospirosis.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: _____________ Date: _______

• The Buyer agrees that if at any time in the life of this puppy the Buyer is unable to keep this puppy for whatever reason, the Buyer shall offer the Seller the Right of First Refusal and the option to buy back this puppy at one-half the purchase price. It is also agreed that this puppy is not to be placed in a new home, given away to a family member or friend, released to a rescue organization, placed in an animal shelter or sold to a third party without prior written approval from the Seller. Failure to notify the Seller that a transfer of ownership has occurred with this puppy will subject the Buyer to liquidated damages in the amount of $5,000.00. • The Buyer agrees that this puppy will be registered with the American Kennel Club and the official name of this puppy on the American Kennel Club registration will have the prefix of my kennel name "MAX".  Any deviations from the use of my kennel name must be approved in writing by the Seller.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: _____________ Date: _______

 

• The Buyer has the option of returning this puppy to the Seller for any reason within the first seven (7) days of purchase, provided the puppy has not been injured through neglect or negligence on behalf of the Buyer.  The puppy must be returned with copies of all medical treatments, all veterinarian invoices, the breeder supplied Health Records and the fully signed and executed AKC Transfer of Ownership Registration.  Any costs or fees involved in returning the puppy to the Seller will be the responsibility of the Buyer. Upon examination by my veterinarian, a full refund will be issued to the Buyer.  The Buyer understands and accepts this as a condition of the sale of said puppy by initialing here: _____________ Date: _______

    

 

All parties have read and understand the terms of this agreement.  No other warranties or guarantees, expressed or implied, are made under this contract, except as stated within. This contract is legal and binding. Agreement is signed and dated in duplicate. This contract signed in the County of Bergen in the State of New Jersey.  Any civil action brought against the Seller/Breeder or the Buyer must be filed in the County of Bergen in the State of New Jersey.
